1.Effect of this notice
1.1 These conditions are subject to periodic amendment. Your continued use of the
Website constitutes your acceptance of these changes. Please ensure that you regularly
visit this page. If you do not agree with such altered Terms you should cease to
use the Website.
1.2 Through use of the Website you may also be subject to additional terms and conditions
of our customers which will be separately displayed.

and we make no, and expressly disclaim, all representations or warranties of any

or breach of statutory duty) or otherwise howsoever in connection with the use of
the Website other than for death or personal injury resulting from our negligence

In particular we shall have no liability for consequential loss or damage suffered,
directly or indirectly, by you or any third party arising from the use of the Website,
including but not limited to wasted time or expenditure, loss of profits, production,
business revenue, expected savings or goodwill or any claim by any person.
2.5 We accept no responsibility for the content or selection of websites or pages
linked to any part of the Website and nor do we endorse or support any such websites.
2.6 Any personal data that you disclose to us is dealt with in accordance with our
Privacy Policy.
3. Intellectual Property
3.1 All IPR is vested in and shall remain vested in Data Driven Logistics Limited
and the website providers as appropriate. Permission is given for the downloading
and temporary storage of any and all of the contents of the Website from time to
time, for the purpose of viewing on your mobile or on a personal computer. The copying,
permanent storage, retransmission, redistribution, publication and modification
of any of the contents of the Website as amended from time to time, is prohibited
without our prior written approval (or except as may be required by law). Written

3.2 We do not permit third parties to hotlink to our Website without our prior written

4. General
4.1 These conditions do not confirm any right enforceable by any third party in
connection with the use of the Website.
4.2 You agree that you will not engage in any illegal or prohibited conduct on or
through the Website.
4.3 The law applicable to these conditions is English Law and you submit to the
exclusive jurisdiction of the English Courts in all matters connected with these
conditions.
4.4 In these conditions "we", "us" and "our" means Data Driven Logistics Limited
and "you" and "your" means the user/visitor.

Man of the Match Voting Guidelines
1. General Voting Guidelines
You may vote by premium rate telephone service only, by dialling the numbers as
specified on Stoke City’s main display Screen within the Britannia Stadium. Please
note it is not possible to vote via SMS, the internet, red button or via email.
You may vote for which player, as indicated on the Screen, you want to be Man of
the Match.
Vote lines are opened and closed as specified on the screen. Votes made or received
outside of these specified times will not be counted but may still be charged.
Voting times are liable to change and Data Driven Logistics Limited may suspend,
withdraw or re-set voting at its sole discretion at any time. Data Driven Logistics
Limited may in its sole discretion at any time change the rules for voting.
Each phone vote costs 50p (50 pence) from a BT landline. Calls from other networks
may be higher and from mobiles will be considerably more. The total cost will be
dependent on your network operator. Please ask permission from the bill payer prior
to voting and please dial carefully and sensibly. There will be no refund for the
cost of any misdialled calls made.
You may dial the numbers as displayed on the Screen. Data Driven Logistics Limited
is committed to operating viewer voting fairly and to preventing abuse of its systems,
as well as those of its agents and sub-contractors. Hence, Data Driven Logistics
Limited reserve the right to discount votes if they have reasonable grounds to suspect,
at their sole discretion, that fraudulent voting has occurred, such that is designed
to excessively manipulate the outcome of the vote. While you may vote as many times
as you like, Data Driven Logistics Limited believes that any votes, which are received
from any one recognised number in excess of 1000 for one player, are deemed to be
designed to excessively manipulate the outcome of the vote and are unfair to other
users and other players. Therefore if you vote more than 1000 times for one player,
we reserve the right to disqualify any votes made above that number, having regard
to all circumstances and information available to Data Driven Logistics Limited
at the relevant time, and if we decide to disqualify votes above 1000, we will refund
the cost of any such votes to you.
The result of the vote will be established from all votes received by the producer
of the Programme at the time when the result is calculated, after the lines have
closed. Please note that votes which have not been received at the time when the
result is calculated will not be counted but may still be charged. Data
Driven Logistics Limited, the hosts of the Screen, agents and sub-contractors do
not accept any responsibility whatsoever for any technical failure or malfunction
or any other problem with any telephone network or line, system, server, provider,
software or otherwise which may result in any vote being lost or not properly received,
registered or recorded.
Data Driven Logistics Limited cannot promise that the phone lines will be free from
errors or omissions nor that they will be available uninterrupted and in a fully
operating condition. The system and/or service may be suspended temporarily and
without notice in the case of system failure, maintenance or repair or for reasons
beyond the reasonable control of Data Driven Logistics Limited, their agents and
sub-contractors, and will not be liable to you or to any other person in the event
that all or any part of the system and/or service is discontinued, modified or changed
in any way.
Data Driven Logistics Limited will not have a say in the outcome of the vote. In
the event that the outcome of a vote cannot be reasonably determined because of
a technical failure or other circumstance beyond the reasonable control of Data
Driven Logistics Limited, the host of the Screen, their agents or sub-contractors,
then the judges’ decision will determine which player is Man of the Match or any
other decision which the vote would have determined. The judges’ decision will be
final.
Nothing in these terms and conditions restricts your statutory rights as a consumer.
For more details on your statutory rights you should contact your local Trading
Standards Office or Citizen's Advice Bureau.
2. Guidelines for Voting by Telephone
To vote by phone, you may dial the premium rate telephone number, as displayed on
the Screen.
Anyone having difficulties getting through to the voting lines should wait and then
try calling again within voting times only. BT has supplied the phone numbers for
voting, but if voting volumes are high, voters using other networks may experience
difficulties in voting.
3. Queries/Complaints
If you have a query about voting, you may register your query with Data Driven Logistics
Limited who can be contacted by phone on 01782 454300. You will need to provide
the following information:
1. Your Name
2. The telephone number of the phone you called from
3. The time(s) you called when you experienced problems
4. If possible, your telephone network operator, e.g. BT, Orange, Vodafone etc
5. A contact telephone number if different from number 2 above
6. Confirmation of the number that you have been dialling
7. The name of the region/town in the UK you are calling from if calling from a
mobile phone
8. The nature of the problem you have experienced when calling

Other Content Guidelines

1. Privacy Statement
Data Driven Logistics Limited fully comply with all laws and regulations relating
to the protection of personal data including the Data Protection Act 1998 (the "Data

2 What information do we collect and why?
2.1 The information collected on the website includes but is not limited to:

to observe your interest of this Website (number of visits, time of visit, location
of screen, length of interaction, requests, votes etc):

screens, our customers content on the screens and how visitors use the site. To
do this, we record the buttons pressed on the mobile phone handset. The type of

such as what pages are most attractive to visitors, which products, content and
advertising is of most interest, and what kinds of offers visitors like to see.
Although the content of the Website is not managed by us, we control how that data

to submit it and that such material does not violate the privacy or publicity rights

2.4 Where you voluntarily provide your contact details we use this:
